1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and ActivityScore ("we", "us", "our") governing your access to and use of the ActivityScore mobile application, website, and related services (collectively, the "Service").

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service. These Terms are governed by the laws of England and Wales.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you confirm that you have obtained consent from a parent or guardian. By using the Service, you represent and warrant that you meet these eligibility requirements.

3. Account Registration

To access certain features you may need to create an account. You agree to:

  • Provide accurate, current, and complete information.
  • Keep your login credentials secure and confidential.
  • Notify us immediately of any unauthorised use of your account.
  • Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for an extended period.

4. The Service

4.1 Description

ActivityScore is a health and fitness tracking application that aggregates data from various sources — including manual input and connected health platforms — to generate a unified activity score and provide personalised wellness insights.

4.2 Health Disclaimer

The Service is intended for general wellness and informational purposes only. It is not a medical device and does not provide medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before making decisions about your health. Do not disregard professional medical advice or delay seeking it because of information provided by the Service.

4.3 Accuracy

While we strive for accuracy, your ActivityScore and related metrics are estimates based on the data available. Results may vary depending on the accuracy of data from connected devices and services. We do not guarantee the accuracy, completeness, or reliability of any health data or scores.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable UK law.
  • Attempt to gain unauthorised access to any part of the Service or its systems.
  • Interfere with or disrupt the Service or servers connected to the Service.
  • Reverse-engineer, decompile, or disassemble any part of the Service.
  • Use the Service to transmit harmful, offensive, or illegal content.
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation.
  • Use automated tools, bots, or scrapers to access the Service without prior written consent.

6. Intellectual Property

The Service, including its design, code, content, logos, trademarks, and all related intellectual property, is owned by ActivityScore or its licensors and is protected by UK and international copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, or create derivative works from any part of the Service.

7. User Content

You retain ownership of any content you submit to the Service (activity logs, profile information, challenge participation). By submitting content, you grant us a worldwide, royalty-free licence to use, process, and display it solely for the purpose of providing and improving the Service.

8. Third-Party Services

The Service may integrate with third-party platforms (Apple Health, Google Fit, Fitbit, etc.). Your use of these platforms is governed by their respective terms and privacy policies. We are not responsible for the content, accuracy, or practices of any third-party service.

9. Subscriptions and Payments

Certain features of the Service may require a paid subscription. If applicable:

  • Prices will be clearly displayed before purchase and include VAT where applicable.
  • Subscriptions renew automatically unless cancelled before the renewal date.
  • You may cancel your subscription at any time through your app store account settings.
  • Refunds are handled in accordance with your app store's refund policy and your statutory rights under UK consumer law.

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have a 14-day cooling-off period for online purchases, except where the digital content has been fully accessed and you acknowledged the loss of cancellation right.

10. Limitation of Liability

To the fullest extent permitted by UK law:

  • The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
  • Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

11. Indemnification

You agree to indemnify and hold harmless ActivityScore, its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, upon reasonable notice. You may stop using the Service and delete your account at any time. Upon termination:

  • Your right to use the Service ceases immediately.
  • We will delete your personal data in accordance with our Privacy Policy.
  • Sections that by their nature should survive termination (including intellectual property, limitation of liability, and governing law) will continue to apply.

13. Changes to These Terms

We may modify these Terms at any time. We will provide notice of material changes via email or an in-app notification at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

14. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Nothing in these Terms affects your statutory rights as a consumer under UK law, including your right to pursue claims in your local courts.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ActivityScore regarding the Service and supersede all prior agreements and understandings.
